Introduction & Acceptance of Terms

Welcome to NEXU WP (nexuwp.com), operated by Nexu WP Development Team, Muscat, Oman. By accessing or using our website, purchasing any plugin, theme, or subscription plan, you agree to be fully bound by these Terms of Service.

If you do not agree with any part of these terms, you must not use our services. These terms apply to all visitors, users, and customers of nexuwp.com.

We reserve the right to update these Terms at any time. Continued use of the service after any changes constitutes your acceptance of the new Terms.

Products & Services

NEXU WP offers WordPress plugins and themes (single or bundled), annual subscription plans for one or multiple websites, access to product updates and new releases during the subscription period, and basic technical support via email.

2.1 Subscription Plans

NEXU WP offers various subscription plans designed to fit different needs. Each plan determines the number of websites you are licensed to use the product on, and is valid for one (1) year from the date of purchase. Available plans and pricing are listed on nexuwp.com/pricing and may be updated at any time. The plan terms that apply to you are those in effect at the time of your purchase. All plans are annual and must be renewed to continue receiving updates and support. Each plan specifies the maximum number of websites the product may be activated on. Using a license on more websites than permitted is a violation of these Terms. Upgrading between plans is available — contact [email protected] for assistance.

2.2 What Is Included

Full access to purchased plugin(s) or theme(s), all updates released during the active subscription period, access to documentation and knowledge base, and email-based technical support.

2.3 What Is NOT Included

Customization or development services, installation or setup services unless explicitly offered, support for third-party conflicts or hosting issues, and access to updates after subscription expiry.

2.4 Product Discontinuation (End-of-Life)

We may discontinue, suspend, delist, or stop offering for sale any product, plan, feature, or service (in whole or in part) at any time, with or without notice.

If a product is discontinued, you may continue using the last version you downloaded, subject to these Terms and any applicable license limitations.

Unless explicitly stated otherwise at the time of purchase, discontinued products may no longer receive updates, fixes, security patches, compatibility updates, new features, or support. We have no obligation to continue development or maintenance of any discontinued product, except where required by applicable law.

This applies to all license types and purchase models, including any “lifetime” or “unlimited” offerings. For clarity, “lifetime” refers to the lifetime of the product and/or our business offering it, not the lifetime of the customer.

Product discontinuation (including for lifetime purchases) does not create a right to a refund and does not entitle you to any compensation. Any refunds, if available, are governed exclusively by our Refund Policy and applicable law.

2.5 Business Changes or Closure

We may change, restructure, transfer, pause, or cease all or part of our business operations, website, and services at any time (including permanently), with or without notice.

In such cases, we are not responsible for any inability to access the website, download areas, license servers, update systems, or support channels, and we have no ongoing obligation to continue providing updates or support, except where required by applicable law. Our Limitation of Liability section applies.

2.6 API Platform (api.nexuwp.com)

We may offer an API platform at api.nexuwp.com that enables integrations with third-party automated processing and content-generation providers. Unless expressly stated otherwise, we act as a technical interface/gateway and do not control or guarantee the outputs, availability, quality, legality, or fitness of any third-party provider.

Third-party providers may change pricing, policies, availability, performance, features, or discontinue their services at any time. We are not responsible for any downtime, degraded performance, unexpected outputs, inaccuracies, service interruptions, provider-side errors, or any losses arising from third-party services or your reliance on them.

You are responsible for your use of the API, including any prompts/inputs you submit, how you use any outputs, and ensuring your use complies with applicable laws and the policies/terms of any third-party providers you choose to access through the API.

We may impose rate limits, usage limits, authentication requirements, monitoring, and abuse prevention measures to protect the platform, comply with provider requirements, and maintain service reliability. We may suspend or terminate API access at any time for security, compliance, abuse prevention, non-payment, or suspected misuse.

API Wallet / Credits

If the API platform uses a prepaid wallet, credits, or balance system, all top-ups and credit purchases are final and non-refundable (including for unused credits), except where required by applicable law. API wallet purchases are separate from plugin/theme subscriptions and are not covered by the Refund Policy in this document to the maximum extent permitted by law.

API wallet credits are valid for a maximum of twelve (12) months from the date of purchase (unless a different validity period is explicitly stated at the time of purchase). Any unused credits expire at the end of the validity period and will not be carried over.

Credits may be deducted based on API usage records and metering logs (including for attempted requests, timeouts, provider-side errors, rejected requests due to policy, rate limits, or other technical failures), and usage calculations may vary by provider and request type. You are responsible for monitoring your usage and maintaining sufficient balance.

To the maximum extent permitted by law, we are not responsible for any third-party provider charges, cost fluctuations, or billing disputes, and we do not guarantee that any specific request will succeed or produce a desired result.

We may change credit pricing, conversion rates, minimum top-up amounts, usage calculation methods, and supported providers at any time. Such changes do not retroactively extend credit validity.

License & Usage Rights

Upon purchase, NEXU WP grants you a non-exclusive, non-transferable license to use the purchased product(s) according to the terms below.

3.1 Permitted Use

Install and activate the plugin/theme on the number of websites covered by your plan, use the product for personal or commercial projects, and customize the product for your own use.

3.2 Prohibited Use

Reselling, redistributing, or sharing the plugin/theme or license key with third parties. Offering the product as part of a nulled or cracked software package. Removing or modifying copyright notices, branding, or author credits. Using one license on more websites than your plan allows. Claiming ownership of the product or any part of its code. Violation of these terms will result in immediate termination of your license without refund, and may result in legal action.

Payment & Pricing

All prices are in US Dollars (USD). Payments are processed through Stripe, PayPal, and WooCommerce Payments. Payment is due at the time of purchase. All transactions are one-time payments — we do NOT auto-renew by default. You will receive an invoice via email after successful payment. Prices are subject to change without notice, but existing subscriptions will not be affected. You are responsible for any applicable local taxes (VAT, GST, etc.).

Refund Policy

Refund requests must be submitted within 14 days of purchase. The product must have a critical bug that our team is unable to fix within a reasonable time, or it must not work as described despite following setup instructions. Refunds are not available for change of mind, incompatibility with unsupported third-party tools, partial subscription periods, discounted or bundled products, or activated license keys. To request a refund, contact [email protected] with your order ID and description of the issue. Our team will respond within 5 business days.

Subscription Renewal & Expiry

Subscriptions are annual and do not renew automatically. You will receive a renewal reminder 30 days before expiry. After expiry, you retain access to the last downloaded version but no longer receive updates, security patches, or support. Renewing restores all benefits for another year. Early renewal extends from the current end date.

Support Policy

Support is available to all customers with an active subscription via email at [email protected]. Support hours are Saturday to Thursday, 9 AM to 6 PM (Oman Time, UTC+4). We aim to respond within 1-3 business days. Support covers installation, configuration, and product-specific bugs. We do not support customizations beyond the product’s intended functionality. We reserve the right to refuse support for abusive or inappropriate communication.

If needed to investigate an issue, reproduce a bug, or provide effective support, we may request temporary access to your WordPress admin area and/or hosting environment (such as a staging site, administrator credentials, logs, FTP/SFTP, database access, or other diagnostic access). You are responsible for ensuring you have the right to share such access, removing any sensitive data where possible, and taking backups before granting access. If you do not provide the requested access, we may be unable to resolve the issue and may close the support request.

Privacy & Data Collection

We collect name, email, username, billing information, usage data, and communication data. This data is used to process purchases, provide support, send product updates and renewal reminders, improve our services, and for advertising via Google and Meta. We use Google Analytics, Meta Pixel, Stripe, PayPal, Cloudflare, and WordPress.com, which may process your data. Full details are at nexuwp.com/privacy-policy.

Cookies & Tracking

nexuwp.com uses cookies and tracking technologies to enhance your experience, analyze traffic, and deliver personalized content and ads. By using our website, you consent to the use of cookies. You may disable cookies in your browser settings, but this may affect website functionality.

Intellectual Property

All products, code, design, branding, and content on nexuwp.com are the intellectual property of Nexu WP Development Team and are protected by copyright and trademark laws. You may not copy, reproduce, or distribute our products without written permission. Open-source components are subject to their respective licenses.

Disclaimer of Warranties

Our products are provided as is without any warranty. We do not guarantee the product will be error-free, uninterrupted, or compatible with every WordPress version or plugin. Use of our products is at your own risk.

Limitation of Liability

Our total liability for any claim shall not exceed the amount you paid for the specific product or subscription. We are not responsible for indirect, incidental, or consequential damages of any kind.

Account Termination

We may suspend or terminate your account for violation of these Terms, unauthorized redistribution of our products, fraudulent payment activity, or abusive behavior. Termination results in immediate license revocation with no refund.

Governing Law

These Terms are governed by the laws of the Sultanate of Oman. Disputes will be resolved through good-faith negotiation, or if unresolved, submitted to the competent courts of Muscat, Oman.

Unless specified otherwise, all Data requested by nexuwp.com is mandatory and failure to provide this Data may make it impossible for nexuwp.com to provide its services. In cases where nexuwp.com specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service.

Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.

Any use of Cookies – or of other tracking tools — by nexuwp.com or by the owners of third-party services used by nexuwp.com serves the purpose of providing the Service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy.

MODE AND PLACE OF PROCESSING THE DATA

Methods of processing

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.

The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of nexuwp.com (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The Data concerning the User is collected to allow the Owner to provide its Service, comply with its legal obligations, respond to enforcement requests, protect its rights and interests (or those of its Users or third parties), detect any malicious or fraudulent activity, as well as the following:

DETAILED INFORMATION ON THE PROCESSING OF PERSONAL DATA

Personal Data is collected for the following purposes and using the following services:

ADVERTISING

This type of service allows User Data to be utilized for advertising communication purposes. These communications are displayed in the form of banners and other advertisements on nexuwp.com, possibly based on User interests.

This does not mean that all Personal Data are used for this purpose. Information and conditions of use are shown below.

Some of the services listed below may use Trackers to identify Users or they may use the behavioral retargeting technique, i.e. displaying ads tailored to the User’s interests and behavior, including those detected outside nexuwp.com.

Google Ads conversion tracking (Google LLC)
Google Ads conversion tracking is an analytics service provided by Google LLC that connects data from the Google Ads advertising network with actions performed on nexuwp.com.

Meta ads conversion tracking (Meta pixel) (Meta Platforms, Inc.)
Meta ads conversion tracking (Meta pixel) is an analytics service provided by Meta Platforms, Inc. that connects data from the Meta Audience Network with actions performed on nexuwp.com. The Meta pixel tracks conversions that can be attributed to ads on Facebook, Instagram and Meta Audience Network.

Google Analytics Demographics and Interests reports is a Google Advertising Reporting feature that makes available demographic and interests Data inside Google Analytics for nexuwp.com (demographics means age and gender Data).

Users can opt out of Google’s use of cookies by visiting Google’s Ads Settings.

Google Analytics 4 is a web analysis service provided by Google LLC or by Google Ireland Limited, depending on how the Owner manages the Data processing, (“Google”). Google utilizes the Data collected to track and examine the use of nexuwp.com, to prepare reports on its activities and share them with other Google services.

Google may use the Data collected to contextualize and personalize the ads of its own advertising network.

In Google Analytics 4, IP addresses are used at collection time and then discarded before Data is logged in any data center or server.

By filling in the contact form with their Data, the User authorizes nexuwp.com to use these details to reply to requests for information, quotes or any other kind of request as indicated by the form’s header.

Users that provided their phone number might be contacted for commercial or promotional purposes related to nexuwp.com, as well as for fulfilling support requests.

Mailing list or newsletter
By registering on the mailing list or for the newsletter, the User’s email address will be added to the contact list of those who may receive email messages containing information of commercial or promotional nature concerning nexuwp.com. WooCommerce Payments is a payment processing service provided by WooCommerce that allows nexuwp.com to process payments for WordPress plugins and themes.

PLATFORM SERVICES AND HOSTING

These services have the purpose of hosting and running key components of nexuwp.com, therefore allowing the provision of nexuwp.com from within a unified platform. Such platforms provide a wide range of tools to the Owner – e.g. analytics, user registration, commenting, database management, e-commerce, payment processing – that imply the collection and handling of Personal Data.

Some of these services work through geographically distributed servers, making it difficult to determine the actual location where the Personal Data are stored.

WooCommerce (nexuwp.com)
WooCommerce is a WordPress plugin used by nexuwp.com that allows the Owner to build and run an e-commerce website for selling WordPress plugins and themes.

Personal Data processed: billing address; email address; name; order ID; payment info; phone number; Trackers; Usage Data.

WordPress.com (Automattic Inc.)
WordPress.com is a hosting and content management service provided by Automattic Inc. that allows nexuwp.com to host and manage its website content.

Personal Data processed: various types of Data as specified in the privacy policy of the service.
Place of processing: United States – Privacy Policy.

REGISTRATION AND AUTHENTICATION

By registering or authenticating, Users allow nexuwp.com to identify them and give them access to dedicated services.

Depending on what is described below, third parties may provide registration and authentication services. In this case, nexuwp.com will be able to access some Data, stored by these third-party services, for registration or identification purposes.

Some of the services listed below may also collect Personal Data for targeting and profiling purposes; to find out more, please refer to the description of each service.

Direct registration
The User registers by filling out the registration form and providing the Personal Data directly to nexuwp.com.

WordPress Login Integration
nexuwp.com integrates with WordPress user authentication system to allow users to log in using their WordPress.com credentials or create new accounts.

SPAM AND BOTS PROTECTION

This type of service analyzes the traffic of nexuwp.com, potentially containing Users’ Personal Data, with the purpose of filtering it from unwanted parts of traffic, messages and content that are recognized as spam or protecting it from malicious bots activities.

Google reCAPTCHA (Google LLC)
Google reCAPTCHA is a SPAM protection service provided by Google LLC or by Google Ireland Limited, depending on how the Owner manages the Data processing.

The use of reCAPTCHA is subject to the Google privacy policy and terms of use.

TRAFFIC OPTIMIZATION AND DISTRIBUTION

This type of service allows nexuwp.com to distribute their content using servers located across different countries and to optimize their performance.

Which Personal Data are processed depends on the characteristics and the way these services are implemented. Their function is to filter communications between nexuwp.com and the User’s browser.

Considering the widespread distribution of this system, it is difficult to determine the locations to which the contents that may contain Personal Information of the User are transferred.

Cloudflare (Cloudflare, Inc.)
Cloudflare is a traffic optimization and distribution service provided by Cloudflare Inc.

The way Cloudflare is integrated means that it filters all the traffic through nexuwp.com, i.e., communication between nexuwp.com and the User’s browser, while also allowing analytical data from nexuwp.com to be collected.

INFORMATION ON OPTING OUT OF INTEREST-BASED ADVERTISING

In addition to any opt-out feature provided by any of the services listed in this document, Users may learn more on how to generally opt out of interest-based advertising within the dedicated section of the Cookie Policy.

FURTHER INFORMATION ABOUT THE PROCESSING OF PERSONAL DATA

Selling WordPress plugins and themes online
The Personal Data collected are used to provide the User with WordPress plugins, themes, and related services, including payment and possible delivery.

The Personal Data collected to complete the payment may include the credit card, the bank account used for the transfer, or any other means of payment envisaged. The kind of Data collected by nexuwp.com depends on the payment system used.

SOFTWARE LICENSE ACTIVATION AND MANAGEMENT

Nexu WP plugins require license key activation to function. When a User activates a license key, the following data is transmitted to and stored on nexuwp.com:

  • The website domain name (URL) where the plugin is being activated;
  • The license key used for activation;
  • The product and variation identifiers associated with the purchase;
  • A unique instance identifier generated for each activation;
  • The timestamp of activation.

This data is processed for the purpose of verifying the validity of the license, enforcing activation limits as defined by the purchased plan, providing software updates, and preventing unauthorized use. The legal basis for this processing is the performance of the contract between the User and the Owner (i.e., the license agreement for the purchased product).

License activation data is retained for as long as the associated license or subscription remains active. Upon license expiration, cancellation, or refund, activation data may be retained for a grace period as configured in the system settings, after which it is automatically deleted.

The Owner (as administrator) reserves the right to view and manage activation records, including removing activations when necessary to assist customers or enforce license terms.

Customers may not delete their own license activations directly. Requests to transfer a license to a different domain must be submitted to the Owner via the contact methods provided in this document.

IN-PLUGIN ANALYTICS AND USAGE TRACKING

Nexu WP plugins include an in-plugin informational page (“What’s New”) that displays product announcements, promotions, and updates fetched from nexuwp.com. When a User views this page, the following anonymous usage data is collected:

  • The domain name (hostname) of the website where the plugin is installed;
  • Page view events (that the page was opened);
  • Block view events (which content sections were displayed);
  • Click events (which links or buttons were clicked).

This data is collected using lightweight image beacon requests (no cookies or local storage are used) and is transmitted to nexuwp.com for the sole purpose of internal analytics — understanding content performance, measuring reach, and improving the quality of announcements and product listings.

No personally identifiable information (such as email address, IP address, or user identity) is collected through this tracking mechanism. The domain name is collected to understand how many unique sites are viewing the content.

The legal basis for this processing is the legitimate interest of the Owner to monitor the performance of its product communications and improve its services.

IN-PLUGIN MESSAGING SYSTEM

The “What’s New” page within Nexu WP plugins includes an optional messaging feature that allows Users to send suggestions, feature requests, or custom order inquiries to the Owner. When a User submits a message, the following data is collected:

  • The email address provided by the User (pre-filled with the WordPress user email, editable by the User);
  • The message content;
  • The domain name (hostname) of the website from which the message was sent;
  • The full site URL.

This data is transmitted to nexuwp.com via a secure REST API endpoint and stored in the Owner’s database for the purpose of responding to the inquiry and managing communications.

An email notification is sent to the Owner when a new message is received. The User’s email address is set as the Reply-To address so the Owner can respond directly.

Messages are retained for a maximum of 6 months from the date of submission, after which they are automatically deleted. The system retains no more than 500 messages at any time; older messages are automatically removed when this limit is exceeded.

The legal basis for this processing is the User’s consent, given by voluntarily submitting the message form. Users can request deletion of their messages at any time by contacting the Owner at [email protected].

PROMOTIONAL NOTIFICATIONS AND COUPON CODES

Nexu WP plugins may display promotional notifications and coupon codes within the WordPress admin area. These notifications are fetched from nexuwp.com and may appear as admin notice bars or within the “What’s New” page. The content of these notifications is determined by the Owner and may include:

  • Announcements about new products or updates;
  • Discount coupon codes and promotional offers;
  • Links to product pages on nexuwp.com.
